Terms and Conditions

1) The projected costs are determined based on our understanding of your requirements and the provided timeline. Any alterations to features, including minor enhancements, may result in additional expenses. We strongly recommend confirming and detailing your requirements and demands during a face-to-face meeting.

2) When you acknowledge a quotation, you are agreeing to abide by VISIBLE GROWTH LLC’s policies and terms. This acknowledgment can be made orally, via email, through payment of the initiation fee, or by signing the quotation document.

3) Clients are responsible for ensuring that all requirements are clearly stated in the quotations and that we fully understand their needs. Clear guidelines and any necessary information should be provided promptly. Failure to do so may result in adjustments to the quote and potential additional costs if significant disparities or ambiguities arise later. It’s crucial for clients to thoroughly explain every aspect of their webpage development to ensure accurate quoting.

4) It’s important to communicate any nuances related to specific tasks upfront and include them in the proposal to accurately track costs. We operate with integrity and rely on clients to provide comprehensive information during the quoting process. VISIBLE GROWTH LLC is not responsible for discrepancies or inconsistencies resulting from unclear requirements.

5) Each project is allocated a set number of hours. Minor adjustments can be accommodated within the agreed-upon timeframe, with consideration given to each case individually.

6) VISIBLE GROWTH LLC is committed to completing the project or any changes within the specified timeframe. However, we acknowledge that rational delays may occur if features or functions are reinvented or modified.

7) Any interruptions on the client’s side may lead to delays in the proposal and suggested timelines, potentially resulting in additional costs.

8) Unless determined otherwise at our sole discretion or required by applicable laws, we do not offer refunds or credit.

9) No additional charges will be incurred for bugs (programming errors) identified during or immediately after development.
 
10) Additional fees will apply for any rework on tasks that have been initially completed. Once changes to the layout have been acknowledged, an additional fee will be incurred.

11) Any requested changes made during or after Go-Live approval will result in additional costs, with all extra work being billed separately. VISIBLE GROWTH LLC cannot be held responsible for any disruptions caused by modifications to the project.

12) All website content and relevant materials must be provided within the initial two weeks of the project. Any potential or unforeseen disruptions may lead to project delays, and if they extend beyond a reasonable timeframe, additional charges may apply.

13) Our webpages undergo testing on PCs using the latest versions of Internet Explorer, Firefox, Chrome, and Safari browsers. Please notify us in advance if you require testing on any other browser.

15) We utilize iPhones and iPads to ensure responsive compatibility of web pages. Kindly inform us in advance if testing is required on a different device. Additionally, please note that any additional hours needed due to network issues for webpages not hosted on a synapse server are not included in our quotes and will be billed separately.

16) Please remember that any project stalling for more than two months will cause $99/week in admin costs. Furthermore, it has the potential to raise previously approved estimates. Putting a project on hold requires prior notice; otherwise, it will not be catered to by the team.

17) When you put a project on hold, there are no additional charges. We will require updating the account before the project is put on hold. If such a situation occurs, a detailed discussion can be held.

18) The software codes developed by VISIBLE GROWTH LLC (excluding open-source software) are protected by copyright. Upon settlement of all previous invoices, the codes can be provided to the customer at an additional cost. These codes are customized for reuse by the customer and are strictly prohibited from being resold or duplicated under any circumstances.

19) VISIBLE GROWTH LLC retains the copyright to all codes developed for each respective client. We provide clients with a license for the exclusive use of any custom-made software, which is included as part of the hosting fee. This license is non-transferable to external hosts, and access to the software codes is strictly prohibited.

20) The website/application is meticulously developed using commercial-grade internet infrastructure. However, performance may be compromised if implemented on an office network due to website traffic.

21) VISIBLE GROWTH LLC endeavours to assess the suitability of third-party elements, but unforeseen limitations are beyond our control. Please note that our estimates do not encompass purchase costs for items such as SSL, Payment Gateway, Google AdWords, Plug-in licenses, etc.

22) VISIBLE GROWTH LLC assumes no responsibility for accessible options such as WordPress, Open-Source Carts, Joomla, etc. It is the client’s responsibility to maintain all elements and third-party software up to date. To prevent disruptions, we advise clients to conduct regular updates.

23) VISIBLE GROWTH LLC offers packages in partnership with third-party vendors. Please note that changes in the rules and strategies of these third-party providers may impact the services we provide.

24) While occasional delays may be unavoidable, we assure you that we will make every reasonable effort to adhere to the proposed schedule. We do not penalize for delays caused unintentionally, provided we maintain our commitment to staying on track.


25) Domain registration, renewal, and associated charges are not automatically included in our project or proposal unless explicitly stated. If a client opts to purchase these items, we will provide a separate estimate for their consideration and seek the client’s approval before proceeding.

26) Hosting fees are not included in the quotation provided by VISIBLE GROWTH LLC. However, if required, we can assist in organizing an appropriate hosting solution tailored to your needs. A personalized quote will be provided and approved by you before proceeding. Should you choose to manage your own web host, we kindly ask that you consult with us beforehand to ensure compatibility with our development technology specifications. It’s important to note that we will require full access to the server and hosting support to adequately test and organize the application. While we strive to minimize disruptions, VISIBLE GROWTH LLC cannot be held liable for any issues arising from the actions of the hosting company.

27) At VISIBLE GROWTH LLC, we conduct thorough testing of internet sites on servers or domains hosted by our team. Please note that access to our test server and websites is restricted to VISIBLE GROWTH LLC personnel only; third-party access is not permitted. However, upon full payment of all invoices and dues, we can transfer the webpage to a designated third-party server as requested.

28) Upon full payment of any outstanding invoices, VISIBLE GROWTH LLC will provide the client with an unconditional permit to utilize, modify, and distribute the visual elements, content, and functionality of the published webpage. This grant extends to recreating, publicizing, and engaging with the materials as desired. However, it’s important to note that this permission excludes intellectual property related to the website’s creation, such as internet advertising, active development, database structures, scripts, forms, or capabilities.

29) As email serves as our primary mode of communication, it is essential for clients to maintain updated email addresses to ensure seamless correspondence.
